Terms of Service

These Terms of Service ("Terms") govern your use of the Verba AI website and services at verba-ai.com (the "Service") operated by Verba AI ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Verba AI is a writing assistant that provides AI text detection, text rewriting and humanizing, and plagiarism checking. The Service uses third-party AI providers (including OpenAI and Google Gemini) to process your text. Results are generated by artificial intelligence and are probabilistic estimates, not definitive determinations.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. By using the Service, you represent that you meet these requirements.

3. User Accounts

  • You are responsible for maintaining the security of your account and password.
  • You must provide accurate and complete registration information.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

Plans

Verba AI offers a free plan and paid subscription plans (Student, Pro, and Pro+). Each plan has specific usage limits described on our pricing page. We reserve the right to change plan features and pricing with 30 days' notice.

Billing

  • Paid plans are billed monthly or annually in advance through Stripe.
  • By subscribing, you authorize us to charge your payment method on a recurring basis.
  • If a payment fails, we may downgrade or suspend your account after a reasonable grace period.

Cancellation

  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
  • No refunds are issued for partial billing periods.

Refunds

New subscribers may request a full refund within 7 days of their first payment. After 7 days, refunds are evaluated on a case-by-case basis. Contact verbaai.support@gmail.com to request a refund.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Submit content you do not own or have the right to use.
  • Generate spam, misleading content, or content intended to deceive.
  • Attempt to reverse-engineer the AI detection or circumvent rate limits.
  • Access the Service through automated means (bots, scrapers) without written permission.
  • Resell, redistribute, or sublicense the Service or its outputs.
  • Submit malicious, illegal, or harmful content.

Academic integrity

Verba AI is a writing assistance tool designed to help you improve your writing skills. You are solely responsible for complying with your institution's academic integrity policies. We do not encourage or condone academic dishonesty. Use of the Service does not guarantee that your work will or will not be flagged by any academic integrity system.

6. Intellectual Property

Our property

The Verba AI name, logo, website, user interface, and underlying technology are our intellectual property. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

Your content

You retain ownership of all text and content you submit to the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the features you request (AI detection, rewriting, plagiarism checking). We do not claim ownership of your content and do not use it to train AI models.

AI-generated content

Text rewritten or modified by the Service is provided to you for your use. You are responsible for reviewing and editing any AI-rewritten content before use. AI-generated content may not be eligible for copyright protection in all jurisdictions.

7. AI Disclaimers

The Service uses artificial intelligence to generate results. You acknowledge and agree that:

  • AI detection results are estimates, not proof. No AI detection tool is 100% accurate. False positives and false negatives can occur.
  • Rewritten text may still be detected as AI-generated by other tools. We do not guarantee that rewritten content will pass any specific AI detection system.
  • Plagiarism results are not exhaustive. The Service checks against available sources but cannot check every source in existence.
  • You should not rely solely on Verba AI's results for consequential decisions. The Service is a writing assistance tool, not a definitive authority.

8. Limitation of Liability

To the maximum extent permitted by law, Verba AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Without limiting the above, we are not liable for any academic, professional, or personal consequences resulting from your reliance on the Service's AI detection, rewriting, or plagiarism checking results.

9. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete.

10. Indemnification

You agree to indemnify and hold harmless Verba AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

11. Termination

  • By you: you may delete your account at any time. Active subscriptions should be cancelled first through your account settings.
  • By us: we may suspend or terminate your account at any time for violation of these Terms, with or without prior notice depending on the severity of the violation.
  • Effect: upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

Sections 6 (Intellectual Property), 7 (AI Disclaimers), 8 (Limitation of Liability), 9 (Warranty Disclaimer), 10 (Indemnification), and 13 (Governing Law) survive termination.

12. Copyright Infringement (DMCA)

If you believe that content on the Service infringes your copyright, please send a notice to verbaai.support@gmail.com with the following information:

  • A description of the copyrighted work you claim has been infringed.
  • A description of where the infringing material is located on the Service.
  • Your contact information (name, address, phone number, email).
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

You agree to resolve disputes with us on an individual basis and waive the right to participate in any class action or class-wide arbitration. This class action waiver is an essential part of this arbitration agreement.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

15. General

  • If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
  • Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • These Terms constitute the entire agreement between you and Verba AI regarding the Service.
  • We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.
